QNB ESOLUTIONS CUSTOMER DISCLOSURE FORM REGARDING THE PROTECTION OF PERSONAL DATA
Dear Customer,
Pursuant to the provisions of the Personal Data Protection Law No. 6698 ("PDPL" or "Law"), your personal data will be processed by QNB eSolutions Electronic Commerce and Information Technology Services Inc. ("QNB eSolutions"), acting as data controller, located at Esentepe Mah. Büyükdere Cad. QNB Bank Kristal Kule Building No:215 Şişli/Istanbul.
"Processing of your personal data" refers to any operation performed on data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, receiving, making available, classifying, or preventing the use thereof.
As QNB eSolutions, we would like to state that we attach the utmost importance to the security of your personal data, and that we continue our operations with the awareness that the security of your personal data is at the forefront in all products and services we offer.
It is our fundamental principle to use your personal data solely for transactions carried out within the scope of QNB eSolutions’ services, while protecting the privacy of your personal life and your fundamental rights and freedoms.
Purposes and Legal Bases for the Processing of Personal Data:
As our customer, the personal data you have shared with us and/or with persons authorized by us may be processed for the following purposes:
1. Identity Information (customer/user name‑surname, Turkish ID number, and company name if it contains personal data)
• Based on the legal basis that compliance with our legal obligations is mandatory, arising primarily from the Regulation on Procedures and Principles Regarding the Registered Electronic Mail System ("KEP Regulation") prepared pursuant to Article 1525 of the Turkish Commercial Code No. 6102 and published in the Official Gazette dated 25 August 2011 numbered 28036, the Tax Procedure Law General Communiqué No. 509 ("VUK General Communiqué"), the Electronic Ledger General Communiqués (Sequence Nos. 1, 2 and 3) ("E-Ledger General Communiqué"), and all other applicable legislation on registered electronic mail, e-invoice and e-ledger; for the provision of registered electronic mail, e-invoice, e-archive, e-ledger, e-delivery note and all other related product and service transactions, processing of applications, identification and verification of identity, recording identification data for all transactions to be performed, updating customer information, complying with the data retention, reporting and notification obligations prescribed by the ICTA, Revenue Administration, Ministry of Treasury and Finance and other authorities, preparing the documents and records that will underpin transactions carried out in paper and electronic media, and fulfilling all obligations arising from applicable legislation.
• Based on the legal basis that processing the personal data of the parties to a contract is necessary, provided it is directly related to the establishment or performance of that contract; for the provision of e-invoice, e-ledger and all other related product and service transactions, opening the account for use, and performing system-related operations such as registration, publication, verification, updating and querying in the KEP directory, and monitoring financial transactions.
• Based on the legal basis that data processing is necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not prejudiced; for contacting the user to send questions, answers, information and notifications relating to the provision of products and services, handling user requests, complaints and inquiries, obtaining quotes and informing you, conducting intelligence and information research, customer satisfaction studies and customer relationship management processes, and measuring, improving, planning and creating statistics on service quality.
• Based on the explicit consent you submit to QNB eSolutions; for planning/executing promotional, marketing, promotion and campaign activities for our services, carrying out the necessary work to enable relevant persons to benefit from the services offered and conducting related business processes, using information such as transaction information, transaction volume, number of transactions, etc. by QNB eSolutions for marketing, development of services, provision of services focused on customers’ needs and improvement of service quality, and carrying out service sales, cross-selling and purchase of additional service credits/units — and in this context commercial electronic messages may be sent to you via e‑mail, telephone or SMS.
2. Contact Information (customer/user e‑mail address, mobile phone number, address information)
• Based on the legal basis that compliance with the legal obligations arising from the legislation to which we are subject is mandatory; for the provision of registered electronic mail, e-invoice, e-archive, e-ledger, e-delivery note and all other related product and service transactions, processing of applications, identification and verification of identity, recording identification data for all transactions to be performed, updating customer contact information, and preparing the documents and records that will underpin transactions carried out in paper and electronic media.
• Based on the legal basis that processing the personal data of the parties to a contract is necessary, provided it is directly related to the establishment or performance of that contract; for the provision of e-invoice, e-ledger and all other related product and service transactions.
• Based on the legal basis that data processing is necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not prejudiced; for contacting the user to send questions, answers, information and notifications relating to the provision of products and services, handling user requests, complaints and inquiries, obtaining quotes and informing you, conducting intelligence and information research, customer satisfaction studies and customer relationship management processes, and measuring, improving, planning and creating statistics on service quality.

3. Customer Transaction Information (request and complaint information)
• Based on the legal basis that data processing is necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not prejudiced; for contacting the user to send questions, answers, information and notifications relating to the provision of products and services, handling user requests, complaints and inquiries, obtaining quotes, conducting intelligence and information research, customer satisfaction studies and customer relationship management processes, and measuring, improving, planning and creating statistics on service quality
4. Transaction Security Information (your application log record)
• Based on the legal basis that data processing is necessary for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not prejudiced; for recording, reporting, auditing, reporting and managing requests for products and services, information security and business processes, and ensuring the security of the data controller’s systems.
5. Marketing Data (information obtained through marketing and campaign activities)
• Based on the explicit consent you submit to QNB eSolutions; for planning/executing promotional, marketing, promotion and campaign activities for our services, carrying out the necessary work to enable relevant persons to benefit from the services offered and conducting related business processes, using information such as transaction information, transaction volume, number of transactions, etc. by QNB eSolutions for marketing, development of services, provision of services focused on customers’ needs and improvement of service quality, and carrying out service sales, cross-selling and purchase of additional service credits/units — and in this context commercial electronic messages may be sent to you via e‑mail, telephone or SMS.
Transfer of Your Personal Data:
Your personal data held by QNB eSolutions may be transferred to the persons, institutions and/or organizations required or permitted by the KEP Regulation, VUK General Communiqué, E-Ledger General Communiqué and other applicable legislation on registered electronic mail, e-invoice and e-ledger, including Article 73/4 of the Banking Law No. 5411 and other laws and regulations, within the scope of conducting our activities in compliance with the legislation and informing authorized persons, institutions and organizations; to public legal entities authorized to receive personal data such as the ICTA, Revenue Administration and SSI; to our main shareholder and the QNB Bank Group companies within the scope of marketing and promotional activities, provided that your explicit consent has been obtained. Furthermore, pursuant to the Law on Regulation of Electronic Commerce No. 6563 and the Regulation on Commercial Communication and Commercial Electronic Messages, your commercial electronic message consents must be registered with the Message Management System ("IYS"), and accordingly your identity and contact information may be transferred to the IYS based on the legal basis of “explicitly provided by law” in order to enable the sending of commercial electronic messages and to manage consent/rejection processes; and may be transferred to authorized public institutions and organizations upon request in order to fulfill our legal obligations and to provide information to authorized bodies. In addition, your personal data held by QNB eSolutions may be transferred to judicial authorities within the scope of the follow-up and conduct of legal proceedings, due to legal necessity and within the limits set by law; and may be shared with institutions and organizations from which services or support are received and/or with which cooperation is established in connection with the provision of our product and service-related services, pursuant to our legitimate interests.
Method of Collection of Your Personal Data:
By applying to QNB eSolutions, you have the following rights in respect of your personal data: I) to learn whether it has been processed; II) to request information if it has been processed; III) to learn the purpose of processing and whether it is used in accordance with its purpose; IV) to know the third parties to whom data has been transferred domestically or abroad; V) to request the correction of incomplete or incorrectly processed data; VI) to request the deletion or destruction thereof within the framework of the conditions set out in Article 7 of the PDPL; VII) to request that the operations carried out pursuant to items (V) and (VI) above be notified to the third parties to whom the data has been transferred; VIII) to object to a result arising to your detriment as a consequence of analysis exclusively through automated systems; IX) to request compensation for any damage you suffer as a result of unlawful processing of your personal data.
Data Controller to Which You May Apply Under the Law:
Pursuant to the regulations of the PDPL, you may submit your request to exercise the rights mentioned above to QNB eSolutions in writing, or through other methods determined by the Personal Data Protection Board, and also via the channels set out below.
